Grapevine Technologies Inc. (“Grapevine,” “our,” “we, “us”) values your privacy. We created this Privacy Policy to explain what information we collect, why we collect it, how we use and disclose it, and what choices and rights you have with regard to your data. This Privacy Policy covers information collected through this website, our web application, and via our Services (collectively, “Services”) relating to individual consumers or households as defined by applicable privacy laws. This Privacy Policy does not apply to third party websites or Services, even if we provide you with links to them.

Our Services are solely intended for individuals located within the United States and are subject to U.S. law. If you are located outside of the United States, please do not use the Services. By utilizing the Services, you consent to the transfer of your data to the United States and its maintenance in the United States, which may not have the same data protection laws as the country in which you initially provided the information.

By using our Services, you acknowledge that you have read this Privacy Policy and consent to Grapevine’s privacy practices as described in the Privacy Policy, including our use and disclosure of your personal information for the purposes described below. You further affirm your consent by submitting content or materials to or through our Services.

If You do not agree to the terms and conditions of this Privacy Policy, including having your personal information used in any of the ways described in this Privacy Policy, please do not provide us with your information or use our Services.

Changes and Updates to this Privacy Policy

Grapevine reserves the right to revise or update this Privacy Policy at any time, and you agree to be bound by those revisions or updates. We will notify you of any changes to the Privacy Policy by posting the revised or updated Privacy Policy and its “Effective Date” on this website and our web application. Your use of the Services thereafter constitutes your agreement to and acceptance of the Privacy Policy and its revisions or updates. You should periodically read the Privacy Policy to learn of any revisions or updates.

Information Collected

Our Services may permit you the opportunity to provide us with Personal Information. As used in this Privacy Policy, “Personal information” means any information that may be used, either alone or in combination with other information, to identify an individual, either directly or indirectly. 

We collect certain information, including Personal Information, from and about you in two ways:

  • directly from you, when you set up an account or otherwise communicate with us;
  • automatically, when you use, or your device uses, our Services.
  • from third parties.

Data You Provide Directly

We collect the following information that you provide to us directly:

  • Personal Identifiers such as:
    • contact name
    • email address
    • account name
    • telephone number
    • IP address
  • Professional/Employment Information such as:
    • employment history
  • Information in Customer Records & Sensitive Personal Information
    • internal communications including messages and posts
      • We collect message content to provide better customer support, troubleshooting, compliance, and marketing purposes.
    • financial information
      • Will sometimes collect financial information, such as information related to your payment method (valid credit card number, type, expiration date or other financial information). This happens when you decide to purchase a paid Service. We do not, however, store that financial information; such information is stored by our payment processor. Please note that if you use the payment processor’s services, your data will be handled in accordance with the payment processor’s privacy policy and practices. We don’t own or control the payment processor and they have their own rules about information collection, use, storage, and sharing, which you should review before using the payment processor’s services. The use of external payment service provider is based on our legitimate interest to you offering Stripe as an additional payment option.   • Information you provide about others
    • If you share with us information about other people (for example, if you use contact details to send communications to buyers/sellers ), we process this information on your behalf in accordance with the terms of any agreement between us and you relating to that information.

Data We Collect Automatically

We may automatically collect data about you when you use our Services including the website. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics so that we can improve our products and Services. This Commercial Purchasing Information & Internet or Other Electronic Network Activity Information may include:

  • device and usage information, such as your IP address
  • browser and device characteristics
  • operating system
  • language preferences
  • referring URLs
  • device name
  • country or location
  • information, including preferences or characteristics, about how and when you use our Services
  • Internal automations/system settings
  • “cookies” and other tracking technologies like pixel tags and web beacons, often called “smart
    cookies” (more information about cookies is below)

Data From Third Parties

Grapevine also receives Personal Information about you from other parties, such as our affiliates, business partners, and service providers. That information may be obtained online, offline, or through publicly available resources. We may combine this data with the information you provide, and other data we already have about you.

Cookies and Other Tracking Technologies

Cookies are text files that are sent by servers to web browsers and stored on your computer. They tell us which parts of our Services you’ve visited so we can alert you to software compatibility issues and save your preferences for future visits to our Services. Web beacons and pixel tags are images embedded in a webpage or e-mail for the purpose of measuring and analyzing usage and activity. Our Services, or third-party service providers acting on our behalf, may use web beacons and pixel tags to help us analyze usage and improve our functionality. Some cookies and other technologies may serve to recall Personal Information previously provided by a user.

We use information collected from cookies and other technologies to improve your user experience and the overall quality of our Services. We use cookies to help us identify and track visitors, your usage of our Services, and your access preferences. We may use your Personal Information to see which web pages you visit at our websites, which website you visited before coming to our website, and where you go after you leave our website. We can then develop statistics that help us understand how our visitors use our websites and how to improve them. Do Not Track Disclosure

Many web browsers include a Do-Not-Track (“DNT”) feature or setting that signals your preference not to have data about your online browsing activities monitored and collected. However, there is currently no uniform standard for recognizing and implementing the DNT signals. As such, Grapevine does not monitor or respond to Do Not Track browser requests. If a standard is adopted that we must follow in the future, then we will inform you about that practice in a revised version of this Privacy Policy.

How We Use Information We Collect

Grapevine uses your information in various ways, including to:

  • provide products or Services you request
  • process your orders
  • perform quality control
  • identify you
  • respond to your questions and support you regarding the use of our Services
  • communicate with you about your account and our Services,
  • comply with applicable law and legal requirements, including valid court orders
  • design, improve, and administer our Services
  • analyze trends and statistics regarding use of our Services and future Service models
  • protect against and prevent fraud, unauthorized transactions, claims, and other liabilities for any
    other purpose if we anonymize the data such that it no longer reasonably identifies you or your
    household
  • provide Services related to selling and sharing of collected analytics data, described further in
    the How We Share Information We Collect section below.

How We Share Information We Collect

We share some information with service providers and partners who assist us in operating the services and, in some cases, legal authorities.
  • With other account holders
    • You share information with other members when you voluntarily disclose information on the service (including your public profile). Please be careful with your information and make sure that the content you share is stuff that you’re comfortable being visible.
  • With our service providers and partners
    • We use third parties and vendors to help us operate and improve our services. These third parties assist us with various tasks, including marketing agencies, design firms, partners/profit sharing partnered businesses for promotional purposes. We do not allow these parties to use your information for any purpose other than to perform those services.

Safeguarding Your Information

Grapevine values your privacy and is committed to protecting your information. We use commercially reasonable administrative, technical, and physical safeguards to ensure the integrity and security of your information. We undertake reasonable efforts to guard against unauthorized access, use, alteration, or destruction of Personal Information.

 

Unfortunately, no security system can be guaranteed to be 100% secure. Accordingly, we do not guarantee the security of your information and cannot assume liability for improper access to it. In some cases, we cannot control, and are not responsible for, information that is shared about you. For example:


Information You Share. Some of our Services may let you share information with others, such as via messaging, posts, and automated emailing. Remember that when you share information publicly, it may be indexable by search engines or otherwise further disclosed.


Social Media Accounts. We maintain various social network accounts such as Facebook, Twitter or LinkedIn. Please note that comments and information that you leave in such settings are likely to be broadly visible and may not be controlled by us. We are therefore not responsible for any information or messages you leave in such settings or for how such information may be used by others. Please review the terms of use and privacy policies of any social network platforms you use, as they will control your rights and responsibilities, and your use of those platforms is not covered by this Privacy Policy.

Your Choices About Your Information

You have choices about how we use your information. Please understand that if you choose not to disclose information to us, it may affect your ability to use some features of our Services or products.

Marketing

If you are a registered user of our Services or have supplied your email address, you agree that in addition to any Services you may have solicited or requested, Grapevine may further send you emails to provide you with information, to inform you of new products, to solicit your feedback, or to keep you up to date on Grapevine and its products.

You can opt out of our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying “STOP” or “UNSUBSCRIBE” to the SMS messages that we send, or by filling out this Request Form. You also may ask us not to send you other marketing communications by contacting us as specified in the “Contact Us” section below, and we will honor your request. Please note that even after you are removed from our marketing lists, we may still send you
non-promotional communications, such as responding to service requests.

Advertisements

Advertisements appearing on any of our Services may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by Grapevine and
does not cover the use of cookies by any advertisers.

Third Party Links

Our website may link to third-party websites, online Services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us—and which may link to other websites, Services, or applications. Please be aware that Grapevine is not responsible for the privacy or practices of other websites or third parties. We do not make any guarantee regarding those third-party websites, Services, or applications, and we are not liable for any loss or damage caused by the use of such sites. Any data collected by third parties is not covered by this Privacy Policy. You should review the policies of the third parties and contact them directly if you have any questions about their Services.

Information Retention

We will only keep your personal information for as long as necessary to fulfill the purposes for which we collect the information, as described in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize your information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Children

Our Services are not intended for use by children. We do not intentionally gather Personal Information about individuals who are under the age of 16. If a child has provided us with Personal Information, a parent or guardian of that child may contact us to have the information deleted from our records. If you believe that we might have any information from a child under age 16, please contact us at support@go-grapevine.com. If we learn that we have inadvertently collected the Personal Information of a child under 16, or equivalent minimum age depending on jurisdiction, we will take steps to delete the information as soon as possible.

Information for California Residents

If you are a California resident, you have specific rights under the “Shine the Light” Law and the California Privacy Rights Act (CPRA). The California Code of Regulations defines a “resident” as:

  • every individual who is in the State of California for other than a temporary or transitory
    purpose, and
  • every individual who is domiciled in the State of California who is outside the State of California
    for a temporary or transitory purpose
All other individuals are defined as “non-residents.” If this definition of “resident” applies to you, then we must adhere to certain rights and obligations regarding your Personal Information.

“Shine the Light” Law

California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits users who are California residents to request and obtain from us, once a year and free of charge, information about the personal information we shared (if any) with other businesses for direct marketing purposes, as well as the names and addresses of all third parties with whom we shared your Personal Information in the immediately preceding calendar year.

The California Consumer Privacy Act

This section of our Privacy Policy provides California residents with a comprehensive description of Grapevine’s online and offline practices regarding the collection, use, disclosure, and sale of personal information and the rights of California consumers regarding their personal information under the California Privacy Rights Act (“CPRA”). This section applies to all California residents (but not including legal entities, such as companies). The section will not apply, however, if the information we collect is exempt from the statute (for example, the CPRA does not protect information that is already protected by certain other privacy laws, and it does not protect information that is already “publicly available,” meaning the information that has already been made available to the general public from federal, state, or local government records.

The Right to Request Disclosure

California residents have the right to request that Grapevine disclose what personal information it collects, uses, discloses, sells, or shares. This is called the “Right to Know”. Under the Right to Know, you can request a listing of the types of personal information we have collected about you, the sources of that information, how we use the information (e.g., our business or commercial purposes for collecting, selling, or sharing personal information), other individuals and business with whom we share personal information, and the specific pieces of personal information that we have collected about you.

  • We will verify your identity. You will need to provide us the following information: email address and full name in order for us to verify that you are who you say you are.
  • We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the webpage or phone number listed below.
  • We will respond to your request within 45 days. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
  • In certain cases, a Request to Know may be denied, for example, if we cannot verify your identity or if providing you the information could create an unreasonable risk to someone’s security (for example, we do not want very sensitive information disclosed inappropriately). If we deny your request, we will explain why we denied it. If we deny a request, we will still try to provide you as much of the information as we can, but we will withhold the information subject to denial. 

In the last 12 months, we have collected the categories of personal information described above under the section “Information Collected.” All such information was collected from sources as described above and for the purposes described above. We only disclose such information to third parties as described in the section “How We Share Information We Collect”.

The Right to Correct Inaccurate Personal Information about You

California consumers have a right to correct inaccurate personal information collected or maintained by Grapevine. If you would like information about you to be corrected, you may contact us through our webpage or customer service. Contact information is at the bottom of this section. When you make a request for correction, you can expect the following:

  • After you request correction, you will need to confirm what information you want corrected.
  • We will verify your identity. You will need to provide us the following information: email address and full name.
  • We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the webpage or phone number listed below.
  • We will respond to your request within 45 days. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
  • In certain cases, a request for correction may be denied, for example, if we cannot verify your identity, the law requires that we maintain the information, or if we need the information for internal purposes such as providing Services or completing an order. If we deny your request, we will explain why we denied it and correct any other information that is not protected from deletion.

The Right to Opt Out of the Sale or Sharing of Personal Information

California consumers have a right to opt-out of the sale or sharing of their personal information by businesses. According to the CCPA, and subject to certain exceptions, a business “sells” personal information when it sells, rents, releases, discloses, disseminates, makes available, transfers, or otherwise communicates orally, in writing, or by electronic or other means, a consumer’s personal information to another business or a third party for monetary or other valuable consideration. Grapevine does not sell or share personal information.

Right to Non-Discrimination

You have a right not to receive discriminatory treatment by us for exercising any of your privacy rights conferred by the CPRA. We will not discriminate against any California consumer because such person exercised any of the consumer’s rights under CPRA, including, but not limited to:

  • Denying goods or Services.
  • Charging different prices or rates for goods and Services, including through the use of discounts or other benefits or imposing penalties
  • Providing a different level or quality of goods or Services
  • Suggesting that the consumer will receive a different price or rate for goods or Services or a different level or quality of goods or Services.

We may, however, charge a different price or rate, or provide a different level or quality of goods or Services, if that difference is related to the value provided to you by your data.
